The Law of March 2, 2022 aimed at combating school bullying creates an offence of bullying that could be punished by up to 10 years in prison in the event of suicide or attempted suicide by the victim. It also improves the right to an education without bullying.
The right to pursue an education without school bullying, established by the law of July 26, 2019 for a school of trust, becomes a component of the right to education . It is extended in the education code to students in private education and to students. The definition of bullying is also completed, in particular to include acts committed on the fringes of school or university life and by staff.
An obligation of means will weigh on public and private schools and higher education establishments as well as on regional centres for university and school works (CROUS), which will have to take appropriate measures to:
- prevent and deal with cases of harassment;
- direct victims, witnesses and perpetrators, in particular towards associations that can support them.
In order to better support victims and harassers, the school or establishment project must establish guidelines and procedures for the prevention, detection and treatment of harassment.
The law complements the measures already implemented by the government, and recalled by the Minister of National Education on November 17, 2021.
