The EU Code of conduct on countering illegal hate speech online

Racist and xenophobic hate speech, online or offline, is a crime in the EU and is not protected by the right to freedom of expression. Under EU law, hate speech refers to expressions which incites to violence or hate targeting a person or group of persons because of their race, colour, religion, ethnic origin or nationality. This is established for in the Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia. The Code of conduct initiated by the Commission in 2016 invites the companies (typically social media companies) to assess quickly and remove, when necessary, content which is hate speech. Several companies are part of the Code, including, for example, Facebook, Twitter, YouTube, Instagram, Snapchat and TikTok. The Code also supports sharing knowledge and good practices with civil society organisations and national authorities, and aims to educate and protect children from being exposed to racist and xenophobic content online.
